Introduction

These Terms of Service ("Terms") govern your use of the Life By Design mobile application ("App") operated by Your Success Australia Pty Ltd (trading as Your Success Club).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms & Age Requirement

By creating an account or using Life By Design, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be legally bound by these Terms
  • You are at least 18 years old
  • You declare that your provided age is accurate
  • You have the legal capacity to enter into this agreement

1.1 Age Verification

During account creation, you will be asked to confirm you are 18 years of age or older. By submitting this information, you certify that it is accurate and truthful. Life By Design reserves the right to verify your age and may request additional documentation if there is reason to believe you are under 18.

1.2 Consequences of False Age Declaration

If we discover you are under 18 or have provided false age information, we will immediately:

  • Suspend or terminate your account
  • Delete all your personal data
  • Refund any unused subscription fees (pro-rated)

2. License Grant

2.1 Limited License

Life By Design grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal device(s)
  • Use the App for personal, non-commercial purposes
  • Access the features and content you've purchased or subscribed to

2.2 Restrictions

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Sell, rent, lease, sublicense, or distribute the App
  • Use the App in any way that violates applicable laws
  • Impersonate another user or provide false information
  • Interfere with or disrupt the App's functionality
  • Use automated systems (bots, scrapers) to access the App
  • Extract or harvest data from the App

3. Account Registration

3.1 Account Creation

To use Life By Design, you must:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Not share your account with others

3.2 Account Security

You are responsible for:

  • All activity that occurs under your account
  • Maintaining the confidentiality of your password
  • Notifying us immediately of any unauthorized access

We are not liable for losses caused by unauthorized use of your account.

3.3 Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse or harass other users or our team
  • Create multiple accounts to circumvent restrictions

4. Subscription and Payment

4.1 Subscription Plans

Life By Design offers:

  • Free Tier: 7-Day Lounge experience
  • Premium Subscription: $9.99/month or $79.99/year (or local equivalent) including access to all 3 chosen Voyages, advanced Pass Wins analytics, calendar streak view, and Travel Vault resources

4.2 Payment Processing

Payments are processed through Apple's In-App Purchase system. Prices are in U.S. dollars or local currency. Subscription automatically renews unless canceled. Payment is charged to your Apple ID account at purchase confirmation.

4.3 Cancellation

To cancel your subscription:

  • Go to Settings on your iOS device
  • Tap your name > Subscriptions > Life By Design > Cancel

Cancellation takes effect at the end of the current billing period. You'll retain access until then.

4.4 Refunds

Refunds are subject to Apple's refund policy. Request refunds through Apple, not directly from us. We cannot process refunds for purchases made through Apple. No refunds for partially used billing periods (except as required by law).

5. User Content

5.1 Your Content

You retain ownership of content you create in the App:

  • Journal entries
  • Photos you upload
  • Gratitude reflections
  • Goal statements

5.2 License to Us

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store and display your content to you
  • Process your content to provide App features
  • Create backups and ensure service continuity
  • Aggregate anonymized data for research and improvement

We do not own your content and will not use it for marketing without your permission.

5.3 Content Restrictions

You agree not to post content that:

  • Is illegal, harmful, or offensive
  • Infringes intellectual property rights
  • Contains viruses or malicious code
  • Violates the privacy of others
  • Is spam or unsolicited advertising

6. Intellectual Property

6.1 Our Rights

All content in the App is protected by copyright, trademark, and other intellectual property laws:

  • App design, graphics, and user interface
  • Daily challenges, quotes, and prompts
  • Voyage structures and methodologies
  • Travel Vault resources and templates
  • Life By Design name, logo, and branding

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the App will be error-free, secure, or uninterrupted.

Life By Design is a confidence-building and goal-setting tool, not:

  • Professional therapy or mental health treatment
  • Medical advice or healthcare services
  • Financial or legal advice
  • A guarantee of specific outcomes

If you need professional help, please consult a licensed professional.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFE BY DESIGN SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from your use or inability to use the App
  • Damages from unauthorized access to your data
  • Damages from third-party content or services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Life By Design, its officers, directors, employees, and agents from:

  • Claims arising from your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another person
  • Content you post in the App

10. Changes to the App

We may:

  • Add, modify, or remove features
  • Update content and challenges
  • Change subscription prices (with notice)
  • Discontinue the App entirely

We are not liable for any modifications, suspensions, or discontinuation of the App.

11. Termination

11.1 Termination by You

You may stop using the App and delete your account at any time.

11.2 Termination by Us

We may terminate or suspend your access immediately if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Cause harm to the App or other users

11.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • Your data will be deleted per our Privacy Policy
  • You remain liable for any outstanding payments
  • Sections of these Terms that should survive remain in effect

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

12.3 Informal Resolution

Before pursuing formal legal action, we encourage you to contact us at [email protected] to resolve the issue informally.

12.4 Australian Consumer Law

Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law (ACL) or other applicable consumer protection legislation that cannot be excluded, restricted or modified by agreement.

15. Apple-Specific Terms (iOS)

15.1 Acknowledgment

You acknowledge that:

  • These Terms are between you and Life By Design, not Apple
  • Apple has no obligation to provide support for the App
  • Apple is not responsible for the App or its content
  • Apple is not liable for any claims related to the App

15.2 Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them against you.
